Terms of Service for WTFog

1. Acceptance of Terms

By creating an account and using WTFog ("the Service", "the App"), you agree to be bound by these terms of service. If you do not agree to these terms, you may not use the service.

The service is operated by Nyordre AS, organization number 934974670, Liankollen 11, 4638 Kristiansand ("we", "us", "our").

2. Age Requirements

You must be at least 13 years old to use WTFog.

If you are between 13 and 18 years old, you must have consent from a parent or guardian before using the service.

Parents and guardians are responsible for minors' use of the service.

3. User Account

3.1 Account Responsibility

You are responsible for:

• Keeping your account information updated and accurate
• Protecting your password and keeping it confidential
• All activity that occurs on your account
• Notifying us immediately if your account is compromised

3.2 Username and Profile

You agree to:

• Not use offensive, threatening, or abusive usernames
• Not impersonate another person or organization
• Not create multiple accounts to circumvent bans or restrictions

4. Permitted Use

WTFog is designed to track trips and share experiences with friends. You can use the service to:

• Record and track trips (walking, running, cycling, skiing, etc.)
• Share trips, photos, and achievements with other users
• Participate in social features like groups, friends, and leaderboards
• Compete in duels and challenges
• Explore and unlock map areas by clearing fog

5. Prohibited Use

You MUST NOT:

• Post illegal content: Threats, harassment, hate speech, pornography, terrorism, etc.
• Cheat or manipulate: Fake GPS data, automated scripts, hacking, exploiting bugs
• Violate others' rights: Copyrighted material, privacy, private information
• Spam or advertising: Unsolicited commercial communication, phishing, malware
• Harass other users: Bullying, stalking, unwanted contact after blocking
• Impersonate others: False identity, imitation of other users
• Abuse the service: Overload servers, DDoS attacks, reverse engineering
• Collect data illegally: Scraping, unauthorized data collection

6. Content and Intellectual Property Rights

6.1 Your Content

You retain all rights to the content you publish (trips, photos, descriptions, etc.).

By publishing content, you grant WTFog a non-exclusive, worldwide, royalty-free license to use, display, store, and distribute your content in connection with operating the service.

You are responsible for the content you publish and must ensure you have the necessary rights.

6.2 WTFog's Rights

All rights to the WTFog app, brand, design, source code, and service belong to Nyordre AS.

You receive a limited, non-exclusive, non-transferable license to use the app for personal use.

6.3 Feedback

If you send us ideas, suggestions, or feedback, we may use them freely without obligation or compensation to you.

7. Premium Subscription and Payment

7.1 Premium Features

WTFog offers an optional Premium subscription with extra features such as:

• Extended number of trip photos
• More active duels
• Extra colors and customization options
• And other Premium features

7.2 Payment

Subscriptions are managed by:

• iOS: Apple App Store (Apple's terms apply)
• Android: Google Play Store (Google's terms apply)

Payments are automatically charged to the payment method you have registered in App Store/Google Play.

7.3 Cancellation and Refunds

You can cancel your subscription at any time through the settings in App Store or Google Play.

No refunds: We do not provide refunds for unused subscription periods. Access to Premium features continues until the expiration date.

If your account is banned due to violation of the terms, you lose access to Premium without a refund.

7.4 Price Changes

We reserve the right to change prices for Premium subscriptions. You will be notified of price changes in advance.

8. Content Moderation

8.1 Reporting

Users can report content that violates the terms. We investigate all reports.

8.2 Content Removal

We reserve the right to remove content that:

• Violates Norwegian law
• Violates these terms
• Is offensive, harassing, or inappropriate
• Violates others' rights

Content may be quarantined for 30 days before being permanently deleted.

8.3 Warnings and Bans

In case of violations, we may:

• Issue a warning with an explanation of the violation
• Temporarily suspend your account (7-30 days)
• Permanently ban your account for serious or repeated violations

You can appeal bans by contacting us at support@wtfog.no.

9. Limitation of Liability

9.1 "As Is"

WTFog is provided "as is" without warranties of any kind. We do not guarantee:

• That the service will be available at all times
• That the service is error-free or secure
• That GPS data is 100% accurate
• That user data will not be lost (although we do our best)

9.2 Use at Your Own Risk

You use WTFog at your own risk. We are not responsible for:

• Injuries that occur during trip activities
• Loss of data due to technical errors
• Abuse of the service by other users
• Losses caused by third-party services (Mapbox, RevenueCat, etc.)

9.3 Compensation Liability

Our liability is limited to what Norwegian law permits. We are not liable for indirect losses, lost profits, or consequential damages.

10. Changes to the Service and Terms

10.1 Changes to the Service

We may at any time:

• Add, modify, or remove features
• Temporarily close the service for maintenance
• Shut down the service (with 30 days' notice)

10.2 Changes to the Terms

We may update these terms. For significant changes, you will be notified via:

• Email to your registered address
• Notification in the app
• Update of the "Last updated" date

Continued use of the service after changes means you accept the new terms.

11. Termination

11.1 You Can Terminate

You can terminate your use of WTFog at any time by:

• Deleting your account through the app (Settings → Privacy → Delete account)
• Stopping use of the service

11.2 We Can Terminate

We may suspend or terminate your access to WTFog if:

• You violate these terms
• You abuse the service
• We are required by law
• We shut down the service

12. Privacy

Your use of WTFog is also subject to our privacy policy, which explains how we collect, use, and protect your personal information.

By using the service, you consent to our processing of personal information in accordance with the privacy policy.

13. Third-Party Services

WTFog uses third-party services such as:

• Mapbox - Map services
• RevenueCat - Subscription management
• Expo - Push notifications
• Google/Apple - Login and payments

These services have their own terms and privacy policies that also apply.

14. Governing Law and Jurisdiction

These terms are governed by Norwegian law.

Any disputes shall be resolved in Norwegian courts, with Kristiansand District Court as the venue.

If any part of these terms is invalid, the remaining parts remain in effect.

16.1 Entire Agreement

These terms, together with our privacy policy, constitute the entire agreement between you and Nyordre AS regarding the use of WTFog.

16.2 No Waiver

If we do not enforce part of these terms, it does not mean we waive the right to enforce it later.

16.3 Transfer

You cannot transfer your rights under these terms to others. We may transfer our rights to another company.
